On Saturday, May 28th, 2011 Officers responded to the CV Mart, located at 1846 North Church Street, Burlington, North Carolina to a report of shots fired.

Responding Officers arrived at the business and located two victims suffering from gunshot wounds. Courtney Kimber, B/M-08/16/86, of Burlington, NC apparently suffering a single gunshot wound to his stomach and Laron Leath, B/M-04/18/91, of Burlington, NC suffering from a single gunshot wound to his back.

Witnesses at the scene indicated that the suspect fled the area in a new model Cadillac SUV. Burlington Police Officers located a new model Cadillac Escalade and initiated a vehicle stop. A passenger fled from the vehicle and Officers were able to apprehend him after a lengthy foot pursuit. Currently Officers are investigating this person has a potential suspect in the shooting. His identity is still under investigation at the time of this news release.

Laron Leath has been treated and released from UNC Hospital and Courtney Kimber is still undergoing treatment and his condition is not known. The Burlington Police Department received assistance from and would like to acknowledge the efforts of the Alamance County Sheriff’s Department and the Graham Police Department during this investigation.

The Burlington Police Department is seeking assistance from the public in the shooting that occurred at the CV Mart on Saturday, May 28th at approximately 0313 hours. Some witnesses who observed the shooting saw a black male, approximately 19 years of age, 5’10, 140 lbs., short braided hair, wearing a light colored baseball cap, black jeans and a light colored shirt. After the shooting the suspect ran back across N. Church St. towards the Thrifty Tire Center and got into an awaiting White Cadillac SRX Suv and leave in a high rate of speed on Graham-Hopedale Rd towards Graham. A short time later a Burlington Officer observed a White Cadillac SRX traveling at a high rate of speed on Harden St. This officer attempted a traffic stop where a black male exited and ran on foot. Officers were able to apprehend this person, however the Cadillac Suv got onto the interstate traveling towards Greensboro.

Officers arrested Tyreck Moore, b/m, age 17 of Center Ave, Burlington and charged him with 1 count of resisting an officer. Moore was placed in the Alamance County Jail under a $1,000.00 secured bond.

One of the victims, Courtney Kimber is still listed in critical condition at Moses Cone Hospital.

On May 29th at approximately 1030 hours, officers with the Charlotte-Mecklenburg Police Department located the Cadillac SRX Suv that failed to stop for Burlington Officers on the morning of May 28th shortly after the shooting from the CV Mart. During the initial traffic stop, S/Sgt. Metters was able to radio to communicators the license plate number. During the encounter by Charlotte Officers they made contact with a Mark Toby, B/M of Charlotte. Charlotte relayed this information to detectives with Burlington on his identity. Later in the week, detectives were able to view video footage from various businesses to include the CV Mart and were able to identify Mark Toby and Tyreek Moore as being directly involved in the shooting of Courtney Kimber and Laron Leath.

On Friday June 3rd, warrants were issue on Mark Toby and Tyreek Moore. Moore, who was still in custody from the original charge of resisting an officer, was charged with 1 ct. of Assault with a deadly weapon with intent t to kill inflicting serious injury and 1 ct. of Assault with a deadly weapon inflicting serious injury. Moore was given an additional $120,000.00 bond.

On June 6th at approximately 1600 hours, Mark Toby, B/M, age 24 of Magnaolia Tree Ln., Charlotte was charged with 1ct. of Assault with a deadly weapon with intent to kill inflicting serious injury and 1ct. of Assault with a deadly weapon inflicting serious injury. Toby was arrested from his residence in Charlotte. Toby was placed in the Alamance County Jail under a $250,000.00 bond. The following agencies assisted in this investigation:

The motive for the shooting is still under investigation. We are still working to identify the other occupants that were in the Suv on the morning of the assault. On June 7, 2011, Investigators learned the true identity of Mark Toby. After his finger prints were submitted to the FBI we learned that Mark Toby was actually an alias for Mark Gasper of the Bronx, NY. After a first appearance today in Alamance County District Court, his bond was increased from $250,000.00 to $750,000.00. Investigators were also able to obtain a booking photo from the NYPD to confirm his identity.

On Monday, June 27 2011, Burlington Detectives were contacted by Detectives with the NYPD regarding the arrest of Tyreek Moore. When Moore was arrested on May 28th and fingerprinted, NYPD officers were notified by the FBI of the arrest. During conversation with New York officers, we learned that Tyreek Moore was actually an alias for Gary Ivey, B/M, DOB 06/14/1990 of Brooklyn, NY. Ivey was wanted by the NYPD on the charge of Murder and Drug Possession. On June 30, 2011, Ivey was charged on a fugitive from justice warrant as it relates to the New York charges. A no bond hold was placed on Ivey in addition to the $125,000.00 secured bond he was already under for the Burlington charges.

The Burlington Police Department is seeking assistance from the public in identifying the two individuals in the attached photographs. The pictures were taken from a business nearby the location of the CV Mart just prior to the shooting. Based on information gained from witnesses, these two unknown black males where seen with Gary Ivey and Mark Gasper getting into the White Cadillac SUV just prior to the shooting. We believe these individuals pictured may have ties to Durham, Charlotte or New York City. As seen in the pictures, one of the unknown black males has very unique tattoo’s on both arms, around his neck and collar bone. Anyone with information on their identity is asked to contact the Burlington Police Department or Alamance County Crimestoppers.
